List of countries exempted of Consular Legalization or Apostille

List of states with which Romania has concluded bilateral treaties or conventions of legal assistance in civil matters providing for the exemption from Consular legalization or Apostille.

Romania has concluded with China, Democratic People's Republic of Korea, Republic of Cuba, Republic of Moldova and People’s Republic of Mongolia treaties/agreements providing exemption from legalization or any other additional formality. These countries are not party to the Convention No 12 abolishing the requirements of Consular legalization or Apostille for foreign public documents, done at The Hague on 5 October 1961, with the exception of Moldova.

Also, Romania has concluded conventions/treaties providing for the exemption from Consular legalization or from any other formality with Albania, Austria, Belgium, Bosnia and Herzegovina, Bulgaria, Czech Republic, Croatia, the French Republic, Poland, Russian Federation, Serbia, Slovakia, Slovenia, the Republic of Hungary. Although these countries are party to the Hague Convention, according to art. 3, paragraph 2 of this multilateral convention, affixing an Apostille is not necessary, because when there is an agreement of such manner between two contracting States, the documents of one party are valid on the territory of the another party without fulfilling any additional formalities (nor Consular legalization neither Apostille).

NOTE:

Regarding China, in practice, this country requests Consular legalization of foreign documents, although there is a bilateral treaty providing exemption from any other formality.

3. Belgium – Convention between the Socialist Republic of Romania and the Kingdom of Belgium on legal assistance in civil and commercial matters, ratified by Decree No. 368/1976, published in the Official Bulletin No.93 / 11.04.1976 - art. 14 and 8 point 2 (in practice, Apostille is required);

4. Bosnia and Herzegovina (by declaration of succession) – Treaty between the People's Republic of Romania and the Federal People's Republic of Yugoslavia on legal assistance, ratified by the Decree No. 24/1961, published in the Official Bulletin No 6/02.06.1961 - art. 47 (Apostille is not required);

5. Bulgaria - Treaty between the Romanian People's Republic and the People's Republic of Bulgaria on legal assistance in cases of civil, family and criminal law, ratified by Decree No. 109/1959, published in the Official Bulletin No. 11 / 31.03.1960 - art. 13 (in practice Apostille is required)

6. Czech Republic – Treaty between Romania and the Czech Republic on legal assistance in civil matters, signed at Bucharest on 11 July 1994, ratified by Law No. 44/1995, published in Official Gazette No 106/31.05.1995 - art. 23 (Apostille is not required)
